Welcome to the Scene+ Power Up Campaign (the “Campaign”)

1. KEY TERMS:

“Active Scene+ Member” means a Scene+ Member who has completed a Qualifying Transaction at any Scene+ Rewards Partner during the Pre-Campaign Qualifying Period.

“Eligible Campaign Participant” means an Active Scene+ Member who has NOT completed a Qualifying Transaction at either a (i) Participating Empire Location and/or (ii) a Cineplex location prior to the start of the Campaign (i.e. October 23, 2023).

“Eligible Campaign Partners” means Empire and Cineplex as defined in the Scene+ Program Terms and Conditions.

“Eligible Transaction” means a transaction listed in the table under the “Eligible Transactions” section below.

“Participating Empire Locations” mean the grocery, convenience and pharmacy stores and locations operated by or under the following banners of Empire: Sobeys, Safeway, IGA, IGA extra, Foodland, Foodland & Participating Co-ops, FreshCo, Chalo! FreshCo, Thrifty Foods, Lawtons Drugs & Needs, Sobeys Liquor, Safeway Liquor, Thrifty Foods Liquor and additional banners as announced by Empire from time to time.

“Pre-Campaign Qualifying Period” means the 12-month period prior to the start of the Campaign (i.e. October 24, 2022 to October 23, 2023).

“Qualifying Transaction” means a transaction where a Scene+ Member: (i) redeems OR earns Scene+ points for eligible products and services at any Scene+ Reward Partner; and (ii) swipes their Membership Card or provides their Scene+ Account number in connection with that Membership Card.

“Scene+ Rewards Partners” means any business or entity authorized by Scene LP and in respect of which a Scene+ Member can earn or be awarded, or redeem Scene+ Points and/or Benefits under the Program and for greater certainty may include Owners, travel rewards partners and other rewards partners.

“Scene LP” means Scene Limited Partnership.

2. HOW TO EARN & ELIGIBILITY:

^∞Campaign begins at 12:01 AM Eastern Time (“ET”) on Monday, October 23rd, 2023 and ends at 11:59 PM ET on Friday, November 17th, 2023 ("Campaign Period”). In order to the eligible for this Campaign offer you must be an Active Scene+ Member who has NOT completed a Qualifying Transaction at either a (i) Participating Empire Location and/or (ii) a Cineplex theatres location within the last 12 months prior to the start of the Campaign. Active Scene+ Members who meet the above conditions are referred to as “Eligible Campaign Participants”. Bonus points will be added within 14 days from the end of the campaign.

A. Earn 500 Bonus Points on First Transaction. Eligible Campaign Participants will receive an [email offer] inviting them to earn 500 bonus Scene+ points through this Campaign as described below (a “First Transaction”):

(i) If the Eligible Campaign Participant is a New Earner to Empire (i.e. has not completed a Qualifying Transaction at any Participating Empire Locations before), then the offer will invite the Eligible Campaign Participant to earn 500 bonus Scene+ points by completing their first Eligible Transaction at a Participating Empire Location during the Campaign Period;

(ii) If the Eligible Campaign Participant is a New Earner to Cineplex (i.e. has not completed a Qualifying Transaction at any Cineplex locations before), then the offer will invite the Eligible Campaign Participant to earn 500 bonus Scene+ points by completing their first Eligible Transaction at a Cineplex location during the Campaign Period;

(iii) If the Eligible Campaign Participant is a New Earner to both Empire and Cineplex (i.e. has not completed a Qualifying Transaction at either any Participating Empire Locations nor any Cineplex locations before), then the offer will invite the Eligible Campaign Participant to earn 500 bonus Scene+ points by completing their first Eligible Transaction at either a Participating Empire Location or Cineplex location during the Campaign Period.

By way of example only, if an Eligible Campaign Participant has not earned or redeemed Scene+ points at Cineplex theatres between October 24th, 2022 and October 23rd, 2023 (i.e. the Pre-Campaign Qualifying Period), and then that Eligible Campaign Participant completes an eligible transaction to earn or redeem Scene+ points at a Cineplex theatre location during the Campaign Period (i.e. a First Transaction), they will earn 500 bonus Scene+ points in connection with that First Transaction.

B. Earn 100 Bonus Points on each Subsequent Transaction. Eligible Campaign Participants who have completed a First Transaction are eligible to earn an additional earn of 100 Scene+ bonus points for each subsequent Eligible Transaction as described below (each, a “Subsequent Transaction”):

(i) If the Eligible Campaign Participant is a New Earner to Empire and has completed their First Transaction at any Participating Empire Location, then that Eligible Campaign Participant will automatically earn 100 Scene+ bonus points when they complete an Eligible Transaction at a Participating Empire Location during the Campaign Period, up to a maximum of 500 Scene+ bonus points; and

(ii) If the Eligible Campaign Participant is a New Earner to Cineplex and has completed their First Transaction at any Cineplex location, then that Eligible Campaign Participant will automatically earn 100 Scene+ bonus points when they complete an Eligible Transaction at a Cineplex during the Campaign Period, up to a maximum of 500 Scene+ bonus points.

For clarity, the maximum number of Scene+ points that can be earned by completing Subsequent Transactions is 500 Scene+ points in total. The maximum number of Scene+ points that can be earned through this Campaign by completing the First Transaction together with any Subsequent Transactions is 1,000 Scene+ points in total.

Eligible Transactions: The below transactions are “Eligible Transactions” in respect of each of the Eligible Campaign Partners for this Campaign.

All other transactions, including but not limited to, use of the membership card to earn through Scene+ Rakuten, redeem points through Scene+ Travel, Powered by Expedia, earn 10% discount off Tuesday movie tickets or apply points to travel do not qualify as an Eligible Transaction. If the Eligible Transaction is returned, cancelled, declined, or fraudulent, or is cancelled by the member or by Scene LP for any reason including but not limited to gift cards or products being out of stock, cancellation of travel by the travel provider (i.e. airline, hotel, car rental company, etc.), cancellation by the entrant due to pandemic, flight cancellations, medical conditions or illness, or by government action or recommendation, or by Scene LP, Scene LP shall void the corresponding transaction into the Campaign.

2. GENERAL RULES

Offer is open to Scene+ members who are legal residents of Canada, who are at least fourteen (14) years of age as of the start date of this Campaign offer is not open to employees, officers, directors, agents or representatives of the Sponsor, any of each party’s respective parent, subsidiary or affiliated companies, licensees, advertising and promotional agencies (collectively the “Campaign Parties”) or their immediate family (defined as parents, siblings, children and spouses, regardless of where they live), or those domiciled with employees, officers, directors, agents or representatives of the Campaign Parties. Void where prohibited.

Bonus Scene+ points earned will be applied to the Scene+ account of the Scene+ card used at the time the Eligible Transaction is completed. In the event of a dispute as to the identity of the Eligible Campaign Participant, Scene LP reserves the right, in its sole and absolute discretion, to deem the Eligible Campaign Participant to be the authorized account holder of the Scene+ Program account associated with the Scene+ card used at the time of the Eligible Transaction. For the purpose of these Official Rules, “authorized account holder” is defined as the natural person who is the registered person as per Scene LP’s records.
